I should clarify
that was supposed to be humorous. My dad was a lawyer and I know some other lawyers who are genuinely good people. The point was: “when the only tool you have is a hammer, everything looks like a nail.” Leave it to a lawyer to deal with this situation by getting the law involved. OK, carry on….
Make no mistake, I have a half-semester of Civil Procedure under my belt as well. I’m chomping at the bit to go to jury duty in two weeks and to answer my subpoena for a separate case a week later.

Everyone knows to get off the court when you lose, don’t whine like a little girl. Also you should know not to throw a basketball at any man’s head much less a competitive, fiery, 19 year old D-1 football player. Then you file a police report when you get punched in the mouth? What the hell did you expect? I see skirmishes happen all the time at gregory and even seen some involving the football players but it usually doesnt amount to much. I guess a punch in the face is crossing the line but don’t instigate a fight and then call the police when you get what you ask for. Mack will probably have to do something about this since you can’t just let your student athletes punch other students in the face, but man what a cowardly move by this kid.

I’ve played many games and I was a supervisor at Gregory….this isn’t a common thing, but I guarantee it happens more times than you think….dude better go into a monastery to avoid the backlash…I got into a tussel with Romance Taylor….ugh…I still hate that guy like no other Texas Player. I fouled him as he was driving in for a dunk(no easy baskets!)….he was upset and we exchanged some words, it was over. Easy as that…

I consider my busted lip from a sharp elbow that haulted my aggressive D a badge of honor. My tooth went all the way through my lip. I also loved playing in the 6 foot and under intramural league there. We had many a good time at Gregory gym. I just hated that I always had to guard one of the woman’s bball players in the pick up games—dang, they would run me ragged.

I don’t know what happened, but law enforcement has charged Vaccaro with assault. Presumably there were some witnesses. So I’m not ready to assume the charges are out of line.

In cases like this, the victim has to press charges for law enforcement to make an arrest. A prosecutor will then decide whether or not to prosecute.
Sure, none of us were there, but even Fuhrman’s own description of the event makes me think that he pees sitting down.

Given that the complaintant admits to assaulting Vaccaro FIRST, no responsible ADA would accept charges on this. Let’s just hope Travis County doesn’t dig up an IRRESPONSIBLE ADA. You don’t really need a witness when the “victim” admits to instigating the fight.

Rules that I shouldn't have had to write down for these dweebs:
1.) Don’t antagonize people who can kick your ass.
2.) Don’t antagonize people who you would like to see kick ass on Saturday.
3.) Don’t call the cops when you get your ass kicked for being a dick at the gym.
4.) Do not invite Fuhrman to any party you hold as long as you live.
5.) If you see this guy at a party, it is your duty to inform the host of his transgressions and have him removed from the premises immediately.

Outside of a club on 6th street. I gotta tell you. Dude was about as nice as they come. He had asked if me and my girl had gone it yet, we politely answered no, so he kept talking to us.
Vaccaro is a good kid, or seemed to be just from talking to him for a few minutes. This is a stupid fight…

So the guy admits that he first assaulted Vaccaro by hitting him in the head with a basketball, and then when Vaccaro retaliates it is Vaccaro’s fault.? Huh
Vaccaro’s alleged comment that the guy was always there looking to start a fight suggests this type of incident to me:
I imagine Fuhrman is shooting hoops and hogging a court because he can and was there first. Totally fine and cool. But, there is gym etiquette.
A group of 6 or more come up and ask him for the Court so they can play 3 on 3 or 4 on 4, or 5 on 5. He says no, cuz he was there first. Uncool move on his part. The group with Vacarro start turning up the heat on him by shooting all their balls whenever he shoots. He gets frustrated and wings his ball at Vacarro.
Gym etiquette is that you yield to the group. Your choice is either (a). go to another open court with single players practicing their shot, or (b). try to get another person to join the group and play on the other team to keep them even numbered—if the group is cool with that. Etiquette is for them to say sure unless of course they already had 5 on 5 OR if you are not at the same level of game. (In which case you shouldn’t have asked unless you are the one way better than them anyway).
Just my speculation. But, Vacarro, being a schollie football player, definitely should have let one of his other friends land the punch.

Disorderly Conduct (Fighting in a Public Place 2-counts): Two UT students began to argue when one student, who was on a losing basketball team, refused to leave the court after a basketball game to allow a new challenging team to take the court. The two students threw basketballs at one-another. When one of the students was struck in the head with a basketball, he ran toward the other student and struck the other in the face with his fist. Occurred on 09/20/09 at 10:35 p.m.
Could be speculation, but it looks like a police report.

There was one this week about a guy walking around campus late at night in his boxers (which he had on backwards), who mistook Burdine Hall (an academic building) for an apartment building and starting banging on the windows. When the cop saw him and asked what he was doing, he said was trying to get his friend to come out of the apartment.

1. Shades of grey. Unless you were physically there with an eyewitness account, there’s no telling whether the instigation was on the part of the student or on Vaccaro. It’s likely that both sides share some blame. Without knowing exactly what happened, let’s not pile on the student just because he happened to file charges against a football player on a team we care deeply about.
2. Not our standard. Like it or not, football players are held to a higher standard. We’ve seen that with recent incidents (Kindle text crashing, Brandon Carter tweeting). Vaccaro has to know that the privilege of playing football for the University of Texas is not without its responsibilities, a fact that I’m sure Mack will remind him of repeatedly.

I’ve been there and done what Vaccaro did. The report says one punch, that’s what I would call a message punch. If he really wanted to put him the hospital he would of threw a few more punches. I think Furhman received the message not to mess with him anymore. I bet furhman didn’t throw another basketball at him after that message punch.
Anyway, Vacarro is a beast on the football field. We gotta find a way to get him on the field either at Safety or DB. The guy can really bring the wood and flies all over the place with wreck-less disregard for his body. Seems to have good hands also.

I mean, I can’t fault him for losing it after getting clocked in the head with a ball, but he’s got to think about losing his privilege of being a UT football player by taking such actions.
It’s a shame that Fuhrman wouldn’t get punished for chucking a basketball at someone’s face. Isn’t that technically assault also? He clearly provoked Vaccaro.

What are the team rules regarding this kind of thing?
I like Horn Brains list of rules, but what do the official team rules state? I hope Kenny hasn’t hurt himself with the coaches. I think he faces more consequence there than he will with the courts.
It does kind of let us know the kind of fire Vaccaro has. He just needs to focus and channel that to the playing field. The Eyes of Texas Are Upon he and all athletes. It comes wiht the territory.

If it drops off without anything else, I dont expect team management to be all that hard on him, for the same reasons that all of us here seem to think its ridiculous, given that the facts as reported are true.
Suspension from some games is probably necessary to send a message though.

I would argue just one game, to send the message that the team knows he was provoked, but that it’s expected that he be the bigger person and not retaliate with violence.
What was the correct answer in this case? Well, if both the guys were throwing basketballs at each other’s head, then it probably would have been to let it go, and just tell the kid to get off the court. If he refused to leave, report that he’s not vacating the court as required, and don’t bring up the basketball-throwing. If this was a case where Fuhrmann was the only one throwing a ball at someone’s head, then report that.

Why did he do a lot of the things he did? Fighting at Gregory Gym was the least of his problems.

However, I think it just further proves my point that this is kind of stuff that kid did. It’s the kind of decisions a person like that would make. He had absolutely no regard for anyone else. I used to watch him in the gym all the time. He once tried to fight a whole gang of small asian kids in an IM game. (Why he was out there in an IM game, I don’t know.)
I dont mean to preach here, but it just annoys me. I’ve definitely seen many atheletes (football players in particular, like VY) come in and play at Gregory and with no problems and are as nice and cordial as ever. They don’t argue or go around punching people in the lip because they didn’t leave the court. Just saying.

But it doesn’t sound like he did this because he didn’t have any regard for anyone else. I don’t think he was looking for a fight. It sounds like this Furhmann guy is a perpetual troublemaker on the pickup courts, and Vaccaro had had enough. It’s easy in hindsight to say he should have let it go. It’s not so easy to actually let it go in the heat of the moment. Sit him for a game, make it clear to him that he better come up with a better response next time, and then leave the kid alone. Everyone makes mistakes, and this is one of the milder ones he could have made.
I have a friend who attended UT back in the late 90's
who got into a fight with a UT football player at an off campus frat party, the football player had jumped one of my friend’s friends. Long story short, the football player got trounced as my friend is a 250 pound ninja from Okinawa Japan, he literally is not someone yo be messed with. Nicest guy in the world, just don’t piss him off. But for inexplicable reasons the school got involved and tossed my friend out of school while levying no penalties upon the football player. It’s funny because to this day he loathes everything about UT because he got screwed.

To be honest, I’m actually a bit hesitant to believe that there was a real ninja taking classes at Texas. I mean, “We’re Texas” and all, but ninjas are basically covert operations specialists, and if they still exist today (or back in the 1990s), I wouldn’t expect them to (a) attend a college in Texas or (b) make it known that they are ninjas.*
