A New Low for the Aggies

Well, well, well... things are really looking gloomy down in College Station. Just when you thought things couldn't get any worse, the Aggies hit a sad, pathetic low - even for them! Perhaps jealous of their rival Longhorns success, and incredulous that a bunch of supposed ninnies from the Northwest might be as psychotic as they are... Texas A&M has filed suit against the Seattle Seahawks seeking an injunction to stop the use of the "12th Man" campaign that the `Hawks have been promoting.

I was going to say something about this being bad for the image of the school in the Northwest, but considering that they breed their students on secret incest farms, I guess it's a moot point.

Still, this is a pretty sad day for the Aggies, considering the timing. Here the Seahawks are, enjoying an unprecedented run of success that's led them to the Super Bowl, and a bunch of pouty spoil-sports go sprinting to the courts to put an end to the party. I knew that the Aggies had a copyright on the recorded "Woot!" sound that the Yell Leaders use, but I wasn't aware that the "12th Man" slogan itself was protected. Apparently it is.

The worst of it is that the Aggies couldn't wait until after the Super Bowl to deal with this. If it were me, I'd wait for the festivities to end, then quietly send a letter to the Seahawks politely saying, "Excuse me, but for next season, can you guys not use that? Technically, we own that phrase. Sorry."

What's the point of making a big fuss of it now? Especially in the midst of the single most media-covered event in all of sports? What's the thinking here? "Hey, here's a chance for some bad publicity! Let's drop an ill-timed lawsuit in the Seahawks face! If we can't win on the football field, we certainly don't want anyone else to, either!"

The wheels, my friends, are coming off in College Station.

DESPERATE FOR PRESS!? seriously though, copyright protection is a serious thing. But I doubt the slogan was ripped off.  Perhaps A & M would be more comfortable replacing "man" with, oh, say, "annoying cadet" or, perhaps "person to bother me in the last hour" as in "HOME OF THE 12TH PERSON TO BOTHER ME IN THE LAST HOUR"

It is huge business
But I agree with Peter, send a letter. If they did and the Seahawks ignored it then I guess this is an appropriate action. I think the Aggies should have a sloggan that says"we could be better with 12 men"

Why not wait?
That's my only point. It just comes across so poorly when you do it in the middle of their first-ever trip to the Super Bowl. They could have handled this nice and quietly. But nooooo

Defending A&M
From what I've read, Texas A&M had given the Seahawks warning some time ago, but the Seahawks have purposely dragged their feet with this issue.  

I'm going to have to defend the Ags on this one, the 12th Man is geuninely their thing and one of college football's best traditions.  For those unaware, they actually pulled some kid out of the stands in 1922 and suited him up because they were so depleted with injuries.  Even though the kid didn't play, it's a huge deal because in theory, it could happen again...

The point I'm trying to make is instead of playing down a copyrighted slogan as Seattle should have done, they went the opposite direction and promoted it further.  Imagine if another team used "Hook 'em" as their rally cry, I'd imagine that'd steam BON considerably.

I'd pay
large amounts of money to see some idiot Aggie fan jump out of the stands, gear up and run out on the field with the team only to have his lunch eaten by Sergio Kindle (though I see a great future for JC, I'm still on the SG Bandwagon).  I'm picturing that scene from "Not Another Teen Movie"...

I would defend a&m, but
the 12th man is an idea that the home team has an extra player in the crowd.  You basically take the number of players on a field and add one, and voila, the ___th man.  Unless it's bowling or golf, then it's the 2nd man.

My point is A&M is good for a barrel of laughs.

I think they actually are selling products with "12 Man" on them. I am sorry but the Aggies should put a stop to this. If they indeed asked the Hawks to stop in 2004 and again this year, and the didn't, then now is as good a time as any.

The Aggies Have to Protect their Mark
As an Alumni of UT and UT Law School, I'm not a big fan of what any Aggies do short of watching them screw up.

But you guys shouldn't criticize Texas A&M for filing suit against the Seahawks.  Texas A&M fans has long been associated with the mark "the 12th man".  The fact is, allowing the Seattle Seahawks to use this mark dilutes the strength of Texas A&M's trademark.  It's better now to enjoin Seattle from using this mark, than to allow the publis to wrongfully associate the mark "12th man" with the seahawks when A&M has long had rights in the mark.

Along these lines
Shouldn't the Aggie Marching Band be suing neo-Nazi groups all across the nation for stealing the goose-stepping schtick?

Shouldn't Aggies be suing every would-be comedian that tells a joke about some minority group being stupid (ie blondes, Poles, W) for stealing their oral histories?

The list could go on but I was about to make a bonfire reference which would likely step well over the bounaries of good taste.  You get the idea...
